Terms of Service.

Acceptance

By downloading, installing, or using TACWAC, you agree to these terms. If you do not agree, do not use the app. You must be old enough to form a binding contract in your jurisdiction to use TACWAC. If you use TACWAC in the course of your work for an agency or employer, you are responsible for complying with that organization's policies; these terms are between you and HolmMade Products LLC regardless.

What TACWAC is

TACWAC is a note-taking and documentation tool. It helps crash investigators capture roadside notes and organize them into structured records, measurement tables, narrative text, Factual Diagrams, photos, and Word document exports of those notes. It also supports optional record sharing between TACWAC users (Officer Assistance) and, for eligible subscribers, synchronization through the user's private iCloud database.

TACWAC is not a report-writing application and is not a records management system. It does not produce, file, or submit official crash reports, and it does not replace dedicated agency software, policies, or procedures for crash investigation or reporting. What TACWAC exports is an organized set of your notes, intended to support the report you prepare through your agency's own systems.

License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use TACWAC on Apple-branded devices that you own or control, as permitted by the App Store terms. This license is for your use of the app; it does not transfer any ownership of the app to you.

Professional responsibility

TACWAC is a note-taking and documentation aid. It is not a report-writing application or a records management system, and it is not a substitute for professional judgment, training, certification, agency policy, dedicated agency software or procedures, engineering analysis, or independent verification, and it does not provide legal advice. You are solely responsible for the accuracy, completeness, and suitability of everything you produce with TACWAC—including measurements, calculations, tables, diagrams, narrative text, warnings you choose to resolve or ignore, imported records, and exports—before relying on it, submitting it, or presenting it in any proceeding.

We make no representation or guarantee that anything produced with TACWAC will be accurate, complete, compliant with any standard, or admissible or persuasive in any investigation, administrative process, or court. Outputs depend on the information you enter and the way you use the tool. Verify your work.

Roadside safety

Crash scenes are dangerous places. TACWAC is designed for fast, glanceable roadside entry, but no app can watch traffic for you. Your situational awareness always comes first: never let documentation take your attention from approaching vehicles, scene hazards, or your own safety procedures. You use TACWAC at an active scene at your own risk. TACWAC does not monitor your surroundings, and to the fullest extent permitted by law, HolmMade Products LLC does not assume responsibility for personal injury, death, or property damage arising from the circumstances in which the app is used.

Your data and your responsibility

Content you create in TACWAC is yours. Because crash-scene records stay on your device (and, if you enable sync, in your private iCloud database), you are responsible for:

• Authority: having the legal authority to collect, record, store, share, and export the information you put into TACWAC, including other people's personal information such as driver-license data, statements, and photographs;
• Compliance: handling that information in accordance with applicable law, records-retention requirements, evidentiary standards, confidentiality obligations, and your agency's policies;
• Recipients: choosing appropriate recipients and transfer methods when you export or share anything, including Officer Assistance packages;
• Backups: maintaining your own backups or exports of work you cannot afford to lose. We do not host your data and cannot recover data that is lost, deleted, corrupted, or unavailable for any reason.

Acceptable use

You agree to use TACWAC only for lawful purposes. You may not use TACWAC to collect or process information you have no right to collect; misrepresent fabricated records as genuine documentation of real events; interfere with or harm any person, system, or investigation; or violate any law or regulation. You may not copy, modify, distribute, sell, lease, or sublicense the app, or reverse engineer or attempt to extract its source code except to the extent the law expressly permits. You are solely responsible for any misuse of TACWAC, and misuse is at your own risk.

TACWAC Pro subscriptions

Some features and higher usage limits require a TACWAC Pro subscription, offered monthly or yearly through Apple's App Store. Subscription entitlements are validated and managed through RevenueCat, our subscription-management service provider, as described in the TACWAC Privacy Policy. Payment is charged to your Apple Account, and subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your App Store account settings; there is no cancellation fee, and cancelling stops renewal at the end of the current period. Prices and included benefits are shown in the App Store and in the app before purchase. If prices or benefits change, the change applies only to later renewal periods, and Apple provides notice of price increases before they take effect. Billing, renewal, cancellation, and refunds are handled by Apple under Apple's terms; refund requests must be made through Apple. If a subscription lapses, paid features stop, but caps only block new additions—your existing data remains available and editable.

Apple

These terms are between you and HolmMade Products LLC, not Apple. Apple has no obligation to provide maintenance or support for TACWAC and is not responsible for the app, its content, or any claims relating to it, including product liability, legal or regulatory compliance, consumer protection, or intellectual-property claims. To the maximum extent permitted by law, Apple has no warranty obligation for TACWAC beyond refunding the purchase price, if any. HolmMade Products LLC, not Apple, is solely responsible for TACWAC and for any maintenance and support, which we provide by email at the address in these terms; Apple has no obligation to provide any maintenance or support. When using TACWAC you must also comply with any applicable third-party terms, such as Apple's Media Services terms and your wireless carrier's agreement. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in an embargoed country and are not on any U.S. government restricted-parties list.

Intellectual property

TACWAC's original branding, design, text, artwork, and software belong to HolmMade Products LLC. Apple marks belong to Apple Inc. Nothing in these terms grants you any right to use our names, logos, or branding. Feedback you choose to send us may be used to improve our products without obligation to you.

Availability and changes to the app

We may update, change, add, remove, or discontinue features of TACWAC—or the app itself—at any time, with or without notice. We do not promise that TACWAC will be available, uninterrupted, error-free, or compatible with any particular device, iOS version, or third-party service. Features that depend on Apple services (such as the App Store, MapKit, or iCloud) or on RevenueCat depend on those services remaining available under their own terms.

Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TACWAC IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement, and any warranties arising out of course of dealing or usage of trade. No advice or information, whether oral or written, obtained from us creates any warranty not expressly stated in these terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOLMMADE PRODUCTS LLC AND ITS OWNER, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO TACWAC OR THESE TERMS—whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and even if we have been advised of the possibility of such damages. This includes, without limitation, damages arising from reliance on any measurement, diagram, narrative, warning, or export; from lost, corrupted, or unrecoverable data; from records you share or receive through Officer Assistance; or from unavailability of the app or any feature.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to TACWAC or these terms will not exceed the greater of the amount you paid us for TACWAC in the twelve months before the claim arose, or fifty U.S. dollars (US $50). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you; in that case, our liability is limited to the smallest amount permitted by law. Each provision of this section allocates risk under these terms and is an essential basis of the bargain between you and us.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HolmMade Products LLC and its owner, officers, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use or misuse of TACWAC; content you create, import, share, or export with TACWAC; your violation of these terms; or your violation of any law or of any third party's rights, including privacy and data-protection rights.

Termination

You may stop using TACWAC at any time; deleting the app removes its local data from your device. We may suspend or terminate your license if you materially violate these terms. Sections that by their nature should survive—including professional responsibility, your data and your responsibility, disclaimers, limitation of liability, indemnification, and governing law—survive any termination.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at the address below and give us 30 days to try to resolve the dispute informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction, except that either party may bring an individual claim in small-claims court. To the extent permitted by law, disputes will be brought only on an individual basis, not as a class, consolidated, or representative action. Nothing in this section waives any right that applicable law makes non-waivable, including any right to seek public injunctive relief where the law preserves that right. If you are a consumer in a jurisdiction whose law gives you mandatory protections or a mandatory venue, nothing in this section takes those away.

Notice to California users

Under California Civil Code Section 1789.3, California users are entitled to know that they may file grievances and complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.

Miscellaneous

These terms are the entire agreement between you and HolmMade Products LLC about TACWAC and supersede any prior agreements about it. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest of the terms remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.

Changes and contact

We may update these terms from time to time. The effective date above identifies the latest version, and continued use of TACWAC after an update means you accept the updated terms.
